The German Supply Chain Act is coming
On 11 June 2021, the German Bundestag passed the Supply Chain Sourcing Obligations Act (LkSG):
- From 2023, it will initially apply to companies with more than 3,000 employees.
- From 2024, it will also apply to companies with more than 1,000 employees.
Protection of human rights
The Supply Chain Due Diligence Act (LkSG) focuses on the far-reaching protection of human rights in the global economy – a range of topics that can be summarized under the term social compliance.
In the course of global supply chains, there is a risk of human rights violations such as child labour, discrimination, exploitation or lack of labour rights. Another aspect is environmental degradation through illegal deforestation, pesticide emissions and water and air pollution.
The Supply Chain Act is intended to oblige German companies to better fulfil their global responsibilities.
At the same time, it is also intended to eliminate competitive disadvantages for companies that already voluntarily invest in sustainable supply chain management as defined by the Supply Chain Act.
Entrepreneurial duties of care
With the Supply Chain Act (LkSG), the legislator sets concrete requirements for corporate due diligence.
It implies that companies must analyse human rights risks, take preventive and remedial measures, establish grievance mechanisms and report on their related activities.
The due diligence obligations of companies basically extend to the entire supply chain – from the raw material to the finished sales product.
The requirements are graduated, in particular according to the ability to influence the perpetrator of the human rights violation as well as the different stages in the supply chain. If there are clear indications of violations, the companies must take action.
Compliance with the Due Diligence Act is reviewed and controlled by the Federal Office of Economics and Export Control (BAFA) as an external authority. In the event of omissions or violations, it can impose fines or exclude companies from public procurement.
