Federal Cabinet Approves Implementation Law for the AI Act.
On February 11, 2026, Germany’s Federal Cabinet gave the green light to the AI Market Surveillance and Innovation Promotion Act (KI-MIG). The law transposes the requirements of the European AI Regulation, the EU AI Act of August 2024, into German national law and establishes the national oversight structures for artificial intelligence. Federal Minister for Digital Affairs and State Modernization Karsten Wildberger emphasized that the law deliberately builds on existing structures and established points of contact. Going forward, the Federal Network Agency (Bundesnetzagentur) will act as the central coordinating body.
Hybrid Approach Leverages Existing Government Structures
More than 1,000 amendment proposals were incorporated during the drafting of the law. The result is a hybrid approach designed to avoid duplicate structures and build on what already works. The Federal Network Agency takes on the central role as a coordination and competence center, pooling AI expertise that it makes available to other authorities as needed.
For companies, this means one thing above all: they keep their familiar regulatory points of contact. The market surveillance authorities that already exist will remain responsible for product regulation and will now also cover the requirements of the AI Regulation. This “one-stop-shop principle” is intended to reduce red tape and create clarity.
Strong Focus on Fostering Innovation
The law goes beyond pure oversight and gives the Federal Network Agency a dedicated innovation policy mandate. Specifically, an AI Service Desk will be set up as a low-barrier point of contact, particularly for small and medium-sized businesses and startups that often lack large legal departments.
Of particular interest: a regulatory sandbox (“Reallabor”) is planned, where innovative AI applications can be tested in a legally secure environment. This will be complemented by networking, support, and training programs tailored to specific target groups. At the same time, the Federal Digital Ministry is pushing in Brussels for further relief measures, such as deadline extensions or the reduction of bureaucratic hurdles.
Clarifications on Media Oversight
The text of the law also includes fundamental clarifications regarding media oversight independent of state influence and the responsibilities of Germany’s federal states. This is particularly relevant for transparency obligations, such as the labeling of deepfakes and AI-generated news content.
Delayed Start Following Formation of New Government
Germany was unable to meet the EU’s original deadline of August 2, 2025, for designating the responsible authorities due to the formation of a new government. As of August 2, 2026, the provisions of the AI Regulation will apply directly. The draft law now moves to the Bundesrat and Bundestag for further deliberation and passage.
